These General Terms and Conditions for parking apply to the use of the Park and Ride (P+R) Parking garage of the Naturalis Biodiversity Center (hereinafter: 'Naturalis') on Mendelweg in Leiden registered at the Chamber of Commerce under number 41169515.
1. Definitions
In these general terms and conditions, the following terms shall have the following meanings:
Customer: Parker.
Parking Operator: The party that carries out the operational management of the parking garage on behalf of Naturalis. Currently, this is P1 Off Street Management B.V., a private limited company with its registered office in Voorburg and its place of business at (2275 AZ) Stationsplein 6.
Parking ticket: The means chosen by the Customer and/or designated by Naturalis – such as a parking ticket, credit card, SmartCard, QR code, registration number, mobile application – that gives access to the Parking garage and on the basis of which Naturalis/Parking Operator can determine the time of entry and exit from the Parking garage.
Parker: Owner, user, holder or occupant of a Vehicle located in or on the Parking garage.
Parking garage: The parking garage and the equipment therein or thereon.
Parking fee: Amount owed by the Customer for the use of the Parking garage.
Parking space: A space marked out within the Parking garage that is intended for the parking of one Vehicle.
PMS: A (parking management) system that controls parking equipment in a parking garage such as the Parking garage, consisting of a (central) computer with specific control software, including interfaces and a database in which the necessary transaction data can be stored.
Parking rate: The parking rate stated at the entrance to the Parking garage, which applies per hour or part thereof or per day.
Vehicle: A passenger car, commercial vehicle or motorcycle.
Terms and conditions: These General Terms and Conditions.
Value cards: Collective name for the agreement between Naturalis and the Customer in the context of a parking arrangement relating to products such as, but not limited to, exit tickets. Website: The Naturalis website (www.naturalis.nl).
2. Applicability
2.1 Access to the Parking garage is only possible under these Terms and Conditions. These Terms and Conditions govern the legal relationship between Naturalis/Parking Operator on the one hand and the Parker on the other hand.
2.2 The Customer's general terms and conditions are expressly rejected by Naturalis and do not apply.
2.3 A one-off parking agreement is concluded in any case by entering the Parking garage. The fact that the Customer is in the Parking garage with a Vehicle or is registered as having entered via the PMS is sufficient to establish use of the Parking garage.
2.4 Naturalis and the Parking Operator may jointly or separately invoke the articles referred to in these Terms and Conditions against the Customer.
3. Performance by Naturalis
Naturalis will make a random unguarded Parking space in the Parking garage available to the Customer as long as there is space available. Naturalis/the Parking Operator is not obliged to guard the Vehicle.
4. Access to the Parking garage
4.1 Provided that the Customer complies with the other provisions of these Terms and Conditions, a Parking Ticket entitles the Customer to access the Parking garage and to drive and park one Vehicle therein. If Naturalis or the Parking Operator finds that a Customer is parking two or more Vehicles at the same time with a single Parking ticket in any way whatsoever, Naturalis is entitled to immediately deny the Customer access to the Parking garage and to impose an immediately payable fine of 100 (one hundred) euros on the Customer. In that case, Naturalis will recover the parking costs, the fine, the damage suffered by Naturalis and the collection costs incurred, plus interest, from the Customer. Naturalis will determine whether and when the Customer will regain access to the Parking garage. The default position is that access will be denied.
4.2 Only Vehicles with a maximum height of 2.1 metres and a weight of less than 2,800 kilograms are permitted to enter the Parking garage. Unless otherwise indicated, the maximum height applies to the roadway of the Parking garage. Other parts of the Parking garage may have different heights. Use of the Parking garage with Vehicles that do not comply with the provisions of this article may result in damage to the Vehicle and/or the Parking garage. Naturalis is not liable for this. Naturalis may hold the person responsible liable for compensation for damage to the Parking garage caused to Naturalis.
4.3 Vehicles as referred to in Article 4.2 are not permitted to enter the Parking garage if they are towing a trailer of any kind, including caravans. Parking trailers of any kind, including caravans, is not permitted. An exception applies to Naturalis/the Parking Operator in the context of business operations.
4.4 The Customer may only park a Vehicle in the designated Parking spaces and in accordance with the instructions given by Naturalis or the Parking Operator, including signage and driving directions. The Customer must keep the entrances, exits and lanes open and passable at all times.
4.5 Naturalis or the Parking Operator may at any time remove (or have removed) Vehicles that are parked in contravention of the provisions of this Article 4 and, if necessary, take them outside the Parking garage. The costs of removal, consisting of hoisting and/or towing costs and all other related costs, will be charged to the owner of the Vehicle.
4.6 Naturalis and the Parking Operator are entitled, at any time, to refuse a Customer and/or their Vehicle access to the Parking garage if they deem this necessary. This will be the case if Naturalis/the Parking Operator knows or suspects that a Vehicle is transporting explosive or other dangerous substances other than motor fuel in the Vehicle's designated tank. This may also be the case if Naturalis/the Parking Operator considers that the Vehicle, given its size and/or weight or the items being transported in it, may cause damage to the environment, in the broadest sense of the word.
4.7 The Parking garage is open 24 (twenty-four) hours a day.
5. User regulations
5.1 Entering the Parking garage is at your own risk. Users of the Parking garage must exercise due care at all times, in particular with regard to the height of the Parking garage outside the lanes.
5.2 It is prohibited to: a. bring any vehicle other than a Vehicle as referred to in these Terms and Conditions into the Parking garage; b. use the Parking garage for purposes other than parking Vehicles; c. offer, sell, rent or distribute goods or services in, on or near the Parking garage; d. advertise in any form whatsoever in or on the Parking garage; e. smoke or light a fire in the Parking garage; f. remain in the Vehicle for longer than is reasonably necessary to park the Vehicle. The Parker must switch off the Vehicle's engine, turn off the lights and lock the Vehicle before leaving the Parking garage; g. carry out repairs to the Vehicle or perform other work in or near the Parking garage, unless expressly permitted to do so by Naturalis or the Parking Operator; h. leave waste in, on or near the Parking garage, other than small waste in the bins provided for this purpose; i. use the ramps, entrances and exits for Vehicles as a pedestrian; j. bringing flammable, explosive, corrosive, toxic or otherwise dangerous and/or harmful substances for humans and the environment into the Parking garage; with the exception of motor fuels in the Vehicle's normal fuel tank; k. using or trading alcohol or narcotics.
5.3 The provisions of the Road Traffic Act (Wegenverkeerswet), the Traffic Rules and Traffic Signs Regulations and the accompanying appendices and further rules apply in the Parking garage. A maximum speed of 5 kilometres per hour (walking pace) applies in the Parking garage and pedestrians always have right of way over Vehicles.
5.4 Without the written permission of Naturalis, a Vehicle may not be parked in/near the Parking garage for more than 28 (twenty-eight) consecutive days. After this period, the Customer will owe, in addition to the parking fee, an immediately payable fine of 25 (twentyfive) euros per day that the Customer's Vehicle is present in/on the Parking garage, without prior notice of default being required. Naturalis also has the right to claim compensation for costs, damage and interest. See also Article 8.2 below.
6. Parking fee and payment
6.1 The Customer owes parking fees for the use of the Parking garage.
6.2 Mediation by third parties in the purchase/acquisition of a Parking Ticket is only possible with the consent of Naturalis.
6.3 Naturalis calculates the Parking Fee according to the rates set by Naturalis as stated at the entrance to the Parking garage or otherwise communicated.
6.4 Naturalis is free to change the Parking Rates.
6.5 If the Parking Ticket does not have a pre-agreed period of validity and/or rate, Naturalis will calculate the Parking Fee according to the rates set by Naturalis based on the length of time the Customer's Vehicle has been present in the Parking garage. The duration indicated by the PMS is decisive in this regard.
6.6 Unless otherwise agreed, the maximum daily rate indicated at the entrance to the Parking garage applies for 24 hours, provided that the Parker enters and exits the Parking garage only once within 24 hours.
6.7 The Parking Fee must be paid before the Parker leaves the Parking garage with his Vehicle, unless other arrangements have been made.
6.8 After payment of the Parking Fee in the Parking garage, the Parking Ticket entitles the Customer to remove their Vehicle from the Parking garage within a period of fifteen minutes. If the aforementioned period expires without the Customer having removed their Vehicle from the Parking garage, a new parking period will commence for which Parking Fees will again be payable at the Parking Rate.
6.9 If the Customer does not agree with the determination of the Parking Fee and any subsequent invoice, he must notify the Parking Operator in writing within 14 (fourteen) days of the date of the invoice at parkeergarage@naturalis.nl, stating his (reasoned) objections. If the complaint is justified, at the reasonable discretion of the Parking Operator, Naturalis will refund the overpaid amount to the bank account specified by the Customer.
Prepaid cards
6.10 A Prepaid Card allows a Parker to pay part or all of the Parking Fee. A Prepaid Card cannot be used in parts; any remaining value will expire.
6.11 The Prepaid Card must be used in accordance with Naturalis' instructions and in combination with the parking ticket taken at the entrance.
6.12 If the Customer decides not to use the Prepaid Card after receipt and/or returns it unused, no refund and/or credit will be given for amounts already paid and/or invoiced.
6.13 A Value Card or its residual value cannot be exchanged for cash.
7. Liability
7.1 Naturalis/the Parking Operator is not obliged to monitor the Vehicle. Naturalis and the Parking Operator are not liable for damage, theft or loss of the Vehicle and/or other property belonging to the Customer.
7.2 Naturalis and the Parking Operator are not liable for any damage to the Customer's property, nor for any physical injury and/or any other damage, directly or indirectly caused by or resulting from the use of the Parking garage, unless the damage was directly caused by or on behalf of Naturalis/Parking Operator and/or the staff present in the Parking garage and this liability is not excluded in any other article of these Terms and Conditions or the agreement with the Customer. The Customer must also report the damage to Naturalis in writing as soon as possible, but no later than two weeks after the damage occurred, so that Naturalis/the Parking Operator can investigate the damage within the prescribed statutory retention periods for personal data.
7.3 Naturalis/the Parking Operator is not obliged to compensate for damage in the event of force majeure. Force majeure shall in any case include circumstances beyond the control of Naturalis or the Parking Operator as a result of which the Customer can no longer reasonably be expected to fulfil its obligations under the agreement. This includes, in any case, strikes, fire, government measures, business interruptions, bad weather conditions such as heavy rain, black ice or snowfall, as well as a failure to perform by third parties.
7.4 Naturalis/the Parking Operator is not liable for direct or indirect, material or immaterial damage resulting from malfunctions or errors in the software of their Website or the failure or malfunction of their Website.
7.5 Under no circumstances shall Naturalis/Parking Operator be liable for damage exceeding the amount that Naturalis or the Parking Operator can claim under their business liability insurance.
7.6 The Customer is liable for all damage caused by him to the Parking garage or the associated equipment and installations. Naturalis is entitled to retain the Parker's vehicle, for example by placing a wheel clamp on it, until the Parker has paid what he owes to Naturalis.
8. Non-compliance
8.1 The Customer and all other persons in the Parking garage must comply immediately and strictly with these Terms and Conditions and with the instructions and orders given by Naturalis or the Parking Operator. Failure to comply with these instructions and orders, or failure to do so in a timely or proper manner, may result in temporary or permanent denial of access to the Parking garage, without prejudice to the obligation of the person refusing to comply to compensate for any damage caused by him or her.
8.2 A Vehicle that has been parked in the Parking garage for 28 consecutive days will be classified as abandoned. Naturalis/the Parking Operator is entitled to move and store an abandoned Vehicle without further notice of default and at the Customer's expense and risk (at Naturalis' discretion), both inside and outside the Parking garage, or to place a wheel clamp on it. The costs of the aforementioned measures shall be paid for by the Parker. Naturalis will recover parking fees, fines, costs and interest from the owner of the Vehicle.
9. Privacy
9.1 The Parking Operator processes personal data on behalf of Naturalis in the context of providing services to the Customer. The Parking Operator ensures that it processes personal data in accordance with applicable laws and regulations, including the General Data Protection Regulation (Algemene Verordening Gegevensbescherming). The 'Privacy Statement' accessible on the Naturalis Website describes how Naturalis handles personal data.
9.2 Camera surveillance is in place in the Parking garage, at the entrance/exit and at the payment machines to support the services provided by the Parking Operator Control Room and to prevent theft and vandalism. These images are deleted after 28 days at the latest, unless Naturalis or the Parking Operator is required to hand them over to the competent authorities.
9.3 Naturalis/the Parking Operator uses number plate recognition when vehicles enter/exit the Parking garage. The number plate is registered in the PMS when entering and exiting. The number plate is registered to determine the parking duration and calculate the parking fee due, and to combat fraud, in particular fraud involving (lost) parking tickets and theft.
10. Other provisions
Electric charging
10.1 Electric vehicles can be charged at charging points in the parking garage, subject to availability; it is not possible to reserve a charging point. The Customer must have their own charging card. Payment for charging costs is made to the charging card provider. The Parker must ensure that the Vehicle has sufficient energy or alternative fuel to leave the Parking garage.
10.2 Once the electric Vehicle has been charged, it must be moved to a Parking Space to make room for other Parkers to charge their Vehicles. If a Vehicle remains at the charging point for longer than 24 hours, it may be moved at the expense of the Vehicle owner or Naturalis/Parking Operator may place a wheel clamp on it.
10.3 Naturalis and the Parking Operator are not liable for damage to the Vehicle as a result of electric charging.
10.4 The customer is liable for damage resulting from parking and/or charging the electric vehicle.
Naturalis employees, suppliers and guests
10.5 These Terms and Conditions also apply to employees, suppliers and guests of Naturalis who are given the opportunity by Naturalis to park in the Parking garage. The right to park expires at the end of the employment.
Miscellaneous
10.6 If any provision in the agreement concluded between Naturalis and the Customer, including these Terms and Conditions, is void, voidable or inapplicable, it will be converted into a provision that does justice as much as possible to the purport of the void, voidable or inapplicable provision. The other provisions will remain in force.
10.7 Naturalis is entitled to amend these Terms and Conditions at any time. The latest version of the Terms and Conditions can be found on the Naturalis website and can be downloaded there. They can also be viewed at the Chamber of Commerce in Leiden.
10.8 These Terms and Conditions are governed by Dutch law. Any disputes arising from the Parking Agreement, including these Terms and Conditions, will be submitted to the District Court of The Hague.
10.9 Complaints can be submitted via the email address parkeergarage@naturalis.nl. The Parking Operator will respond to complaints as soon as possible.
